Terms of use for DM BOŚ SA web services

DM BOŚ S.A. web services are the sole property of Dom Maklerski Bank Ochrony Środowiska S.A. with headquarters in Warsaw, 00-517 ul. Marszałkowska 78/80, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, 12th Commercial Department of the National Court Register, under number 0000048901, with share capital in the amount of PLN 23,640,000, paid in full (hereinafter “DM BOŚ S.A.").
Web services (hereinafter "Services") are directed to all visitors to the Service, including Clients of DM BOŚ S.A., hereinafter collectively referred to as "Users". Service Users who are not DM BOŚ S.A. Clients have a free access to the Services in a limited scope, in particular only to delayed data. Service Users who are clients of DM BOŚ S.A. have access to the Services in the scope specified in the Agreement concluded with DM BOŚ S.A. and in the selected service package. A full description of the functionality for each of the offered packages is available on the bossa.pl website in the Packages tab.

This material, prepared by DM BOŚ S.A., is for information purposes only and does not constitute an offer (within the meaning of the Act of 23 April 1964 Civil Code (as published in Dziennik Ustaw of 1964, No. 16, item 93, with further amendments) for a sale or purchase of instruments or an invitation to submit an offer to subscribe or acquire financial instruments or use investment services in any jurisdiction, or provide investment advice or investment advice, nor is it an indication that any investment or strategy is appropriate in the individual investor's circumstances.

In addition, this material is not directed to or intended for persons with resident status in the United States of America (USA) or persons with a resident status in other countries temporarily present in the USA or any civil or capital companies and entities established and existing under USA or any of the states’ laws, territories or possessions subject to USA tax law. This material may not be distributed, directly or indirectly, in the United States of America, Australia, Canada or Japan, or any other jurisdiction in which such material would be unlawful.

Acceptance and changes to the Terms of Use of the Services

By using the Services and browsing them, you accept these Terms of Use. In the absence of acceptance of the Terms of Use, further use of the Services is not permitted. Using the Services does not result in any relationship with DM BOŚ S.A. or cooperating entities, in particular, does not entitle to exercise the rights of Users who are clients of DM BOŚ S.A.

Protection of copyright and intellectual property rights

All trademarks and content of the Services are protected by copyright, resulting from the Act of 4 February 1994 on Copyright and Related Rights (as published in Dziennik Ustaw of 2017, item 880, with further amendments) and other provisions regarding intellectual property rights. The User has the right to download and print entire pages or fragments of materials posted on the Services, on condition of non-infringement of DM BOŚ S.A copyrights. Making copies, reproductions, placing data contained in the Services (also after their processing) in public places, both in the form of printouts or in electronic form - on websites and on discussion lists, without the consent of DM BOŚ S.A., is prohibited.

Packages of some Service Users who are clients of DM BOŚ S.A., enable them to use part or all of PAP messages. DM BOŚ S.A. does not provide any guarantee of the accuracy, timeliness and completeness of information provided by the PAP website. The data transmitted as part of the PAP website is subject to a protection resulting from the Copyright and Related Rights Act.

The User may use the information contained in the Services only for his own internal information needs, without the right to distribute them in any form, as well as without the right to disclose them to third parties without the consent of DM BOŚ S.A.

Information about cookies and Web / Local Storage technologies and similar

DM BOS S.A.’s web services use a mechanism of the cookie files. Cookies are small text files that the Service saves on the User's computer through the web browser used to work with the Services. 
The Services also use a different technology of this type in the form of writing and reading Web / Local Storage information. Web / Local Storage is a separate part of the browser's memory used to store data saved by the Services. Access to it can only be obtained by the Service operating on the same website from which the data was saved, but unlike cookies, they are not sent by the browser to the Website server. Web / Local Storage technology allows you to store cookie-like information, especially in new environments or in environments where cookie technology is not working properly or cannot work.

Cookies as well as Web / Local Storage technology do not contain nor collect any personal data of Website Users that would enable DM BOŚ S.A. identification of Users. Cookies as well as information saved in Web / Local Storage and access to them by DM BOŚ S.A. Services do not introduce any configuration changes in the User's device or software in any way, nor do they destroy or damage the User's system, or intentionally do not adversely affect its performance or functionality. In addition, they do not affect files stored in the User's computer memory. Identification takes place automatically, impersonally, namelessly, and these are data regarding only the manner and form of using the Services.

Cookies and Web / Local Storage information are saved on Users' computers at the time of making calls in order to:

1. gather information that is necessary to complete access to transaction systems:

• Session cookies that remain on the User's computer until log out / leave of the Services or disabling the browser used by the User 

• Session Storage, where data is stored until the browser window (or bookmark) is closed with the page displayed 

2. adaptation of services and presented content to the individual needs and preferences of the User, as well as collecting information about the way the User uses the websites that help DM BOŚ S.A. understand how Users use the Services. As a result, we are able to improve and improve the Services so that the use of them was even easier and more convenient:

• permanent cookies that remain on the User's computer for the time specified in the file parameters or until they are manually removed from the computer by the User; 

• Local Storage, where the data is stored by the browser and are not deleted when the browser is closed or have a specific validity period. The removal of Local Storage data may be carried out by the Website or by the User himself, through tools embedded in the browser, provided that the browser provides such mechanisms. 

Standard settings of web browsers allow accepting and storing cookies on the User's computer as well as saving information in Web / Local Storage. Website Users can block and delete cookies and Web / Local Storage information from their computer by configuring the browser settings or by using appropriate browser add-ons. 

Lack of blocking of cookies and Web / Local Storage information in the User's browser will be recognized by DM BOŚ S.A. as User’s consent to store by DM BOŚ S.A. in his telecommunications terminal device information within the cookies and Web / Local Storage technology and access to this information, in accordance with article 173 paragraph 2 of the Act of 16 July 2004 Telecommunications Law (consolidated text: Dziennik Ustaw of 2017, item 1907, with further amendments). 

The User should be aware that the complete disabling of the option to save cookies or Web / Local Storage technology may, however, hinder or completely block the possibility of using the services and information made available through the Services.

Information about Google Analytics and DoubleClick

The Services use Google Analytics and DoubleClick services, i.e. web analytics service provided by Google, Inc. ("Google") that uses cookies to determine how Users use the Services. Cookies used by the Google Analytics and DoubleClick services do not contain your personal data. The statistical information generated by the Analytics and Double Click services will be transferred to Google and processed in accordance with the Google Analytics Terms of Use and the Google Privacy Policy.

Disclaimer

Services run by DM BOŚ S.A. are for information purposes only. DM BOŚ S.A. makes every effort to ensure that the materials posted on the Services are complete and comply with the actual and legal status. DM BOŚ S.A. shall not be liable for delays, errors, omissions or interruptions in data transmission that may occur during the use of the Services if they result from circumstances for which DM BOŚ S.A. is not liable or as a result of reasons attributable to third parties for the activities of which DM BOŚ S.A. is not responsible.

DM BOŚ S.A. also does not bear any responsibility for the effects of using the data published on the Website in making investment decisions. If you intend to make investment decisions based on prospectuses or other documents and information placed on the Services or in the event of any doubts as to their validity, we recommend phone or email contact with DM BOŚ S.A.

DM BOŚ S.A. informs that the only reliable source of stock exchange information is the WSE list quotations, and the only reliable source of information on trading in securities on the Catalyst market is the BondSpot SA Information Bulletin.

DM BOŚ S.A. 

• has the right to partially or completely block access to the Services without prior notice, should an emergency situation be detected, in particular: unauthorized access, attempts to break existing security or attempt to block the Services

• has the right to immediately withdraw the access granted to some of the Services to Users who are DM BOŚ SA Customers who have a specific service package in the event of loss of rights that was a condition for granting it, including not paying the required fee, closing the investment account or granting the account inactive status or failure to fulfill the rules of using the Services by the User being a DM BOŚ SA Customer.

 
Redirecting to websites of other entities

Services pages may contain banners and links redirecting to websites of other entities. DM BOŚ S.A. it makes no warranty or liability for information, products or services described on pages visited as a result of the use of these links or banners. The risk of using these websites lies solely with the User.

Changes to the Terms of Use of the Services

DM BOŚ S.A. reserves the right to modify the Terms of Use of the Services. About changing the terms of using the Website, DM BOŚ S.A. will inform at least 7 days prior to their introduction through information placed on the Services. Information on changing the Terms of Use of the Website will contain a list of changes made or, in the event of a large number of changes, a uniform text of the new Terms of Use and the date from which the change or new Terms of Service will apply.

The continued use of the Services by the User, after notification of changes to the Terms of Use of the Services, will be considered as their acceptance.

Present terms of Use of DM BOŚ S.A. are effective from May 25, 2018.
